(Equal pay to Men & Women for Equal or similar work in nature, ILO Convention No. 100)



The wage differentiation on the basis of Gender has been common around the world for decades.

The comment has been received from both aspects. Generally women are considered to be incompetent when it is about physical or heavy muscular work. The cost to company in case of Women worker also supposed to be more than men. Indian Legislation always tried for the betterment of working condition of Women employees by ensuring health & Safety measures such as Crèches (Section 48 under The Indian Factory Act 1948), Maternity Benefits (Under Maternity Benefit Act 1961), Working hours and Shifts related prohibitions Under Indian Factory Act, Section . On the one hand these kind of Intramural measure of Welfare provided by Indian Govt. become boon for Women workers, on another these measure tend to increase cost to company of Women workers. These legislations involve lots of Paperwork that is also time taking and expensive. Some people are in opinion that women work to support their little family and she is not the real earner this reason is enough to pay them less in comparison to any men worker in the same industry.

 

The ILO Convention no 100 advocated  equal pay to Men and Women for Equal or similar work in nature. The General conference of International Labour organization decided this in the 34th session held in Geneva, Called as Equal Remuneration Convention 1951. India has also ratified this convention through The Equal Remuneration Act 1976. The main feature of this act is 1. Non partiality in payment of Men & Women Workers 2. No discrimination is to be made while recruiting. (Any how the second feature of the act is not practically acceptable in most of the industries)

In fact we cannot discriminate men and women on the basis of the natural differences that would be totally injustice on their part. Women are to be raised and to be giving social importance in order to make a bridge between these gaps that can only be done by providing them with equal opportunity, Equal pay, Equal Importance. 

 

But Reservation?
